Your affirmative act of using our website located at www.tradegatehub.com (and all associated sites linked to it) or the services (“TradeGATEHub”) means that you accept the following terms and conditions of use (“Terms of Use”). If you do not agree, do not use TradeGATEHub. TradeGATEHub is sponsored by Tradeview LTD. (“we” or “our”).

1. Changes to the Terms of Use

We may modify these Terms of Use at any time. If you continue to use TradeGATEHub after we post changes to these Terms of Use, you are accepting the new terms. You will always have access to our Terms of Use and can review them at any time. By reloading this page, you will have the most up-to-date version available to users of TradeGATEHub.

2. Changes to TradeGATEHub

We may discontinue or change any service or feature on TradeGATEHub at any time without notice. We do not guarantee backward compatibility of our services or Application Programming Interface (API) in this case.

3. Ownership of Information; License to Use TradeGATEHub; Redistribution of Data

Unless otherwise stated, all rights, title, and interest in TradeGATEHub, and all information available through TradeGATEHub or our services, in all languages, formats, and media worldwide—including, but not limited to, all copyrights and trademarks—are the exclusive property of TradeGATEHub, our affiliates, or our Data Providers, as defined in Section 6 (Content Disclaimer) below.

All rights, title, and interest in any data or other information provided by Interactive Data (IDCO), and all such data/information made available by Interactive Data (IDCO) through TradeGATEHub or our services, in all languages, formats, and media worldwide, including all copyrights and trademarks, are the property of Interactive Data (IDCO), our affiliates, or our Data Providers (as applicable).

You may not use data mining, robots, or similar data gathering and extraction tools on the content of TradeGATEHub, frame any part of TradeGATEHub or its content, sublicense, assign, transfer, sell, lend, or otherwise distribute the content of TradeGATEHub for payment without our prior written consent. You may not circumvent any mechanism included in the content of TradeGATEHub to prevent unauthorized reproduction or distribution of TradeGATEHub content. Except as expressly permitted above, you agree not to sell any of the services or materials in any way or for any purpose without the prior express written consent of TradeGATEHub and/or our Data Providers. Furthermore, you shall not, without the prior express written consent of TradeGATEHub and the applicable Data Providers, make copies of any programs or documentation that may be provided to you, whether in electronic form or otherwise, including, but not limited to, translation, decompilation, disassembly, or creation of derivative works.

Unless expressly permitted by an additional agreement, we do not allow the commercial use of any of our services or APIs. We make no warranties and assume no obligations or liability for third-party services or software. See Section 19 (Third-Party Software) below for more information.

4. Attribution

TradeGATEHub grants all users of tradegatehub.com, and all other available versions of the site, the right to use screenshots of TradeGATEHub charts in analysis, press releases, books, articles, blog posts, and other publications. In addition, TradeGATEHub authorizes the use of all the aforementioned materials in educational sessions, the display of TradeGATEHub charts during video broadcasts—including recaps, news, and analysis—and, in general, the use or promotion of TradeGATEHub charts or any product from the TradeGATEHub website, provided that attribution to TradeGATEHub is clearly visible at all times when such charts and products are used.

Attribution must include a reference to TradeGATEHub, including, but not limited to, the references described herein.

The use of TradeGATEHub charts in videos or other promotions where attribution to TradeGATEHub is not visible must include a description of the product used, for example: “The charting platform used for this analysis is provided by TradeGATEHub” or simply “Charts by TradeGATEHub.” The font size must not be smaller than 10 PT = 13 PX = 3.4 MM.

You may use the “Snapshot” button in the chart’s top toolbar to instantly create an image of your current chart.
TradeGATEHub will automatically take a snapshot with all required attributions and provide a link where you can view, download, or share your chart. The use of any TradeGATEHub product outside the TradeGATEHub website, without proper attribution to TradeGATEHub, is not permitted. Users who fail to comply may be permanently banned, and additional legal action may be taken to ensure compliance. This includes, but is not limited to, cease and desist notices, court orders, injunctions, fines, damages, etc.

5. Third-Party Sites and Advertisers

TradeGATEHub may include links to third-party websites. Some of these sites may contain objectionable, illegal, or inaccurate materials. You agree that TradeGATEHub will not be responsible for any trading activity or other activities that occur on any website you access through links on TradeGATEHub. We provide these links as a convenience and do not endorse the content or services offered by such other sites. Any dealings you have with advertisers found on TradeGATEHub are between you and the advertiser, and you acknowledge and agree that we are not responsible for any loss or claim you may have against an advertiser.

Unauthorized solicitation on TradeGATEHub is strictly prohibited and may result in penalties, including, but not limited to, temporary or permanent suspension of the infringing account, and any appropriate legal action to obtain monetary or other damages.

6. Content Disclaimer

TradeGATEHub cannot and does not guarantee that any of the information available through our services or on TradeGATEHub is accurate, reliable, current, complete, or suitable for your needs. Various information available through our services or on TradeGATEHub may be specifically obtained by TradeGATEHub from professional companies or organizations, such as exchanges, news providers, market data providers, and other content providers (for example, Cboe BZX and possibly other established financial exchanges such as the New York Stock Exchange, NASDAQ, New York Mercantile Exchange, and Dow Jones), which are considered reliable sources of information (collectively, the “Data Providers”). However, due to various factors—including the inherent possibility of human and mechanical errors—the accuracy, completeness, timeliness, results obtained from use, and correct sequencing of the information available through our services and website are not guaranteed by TradeGATEHub.

We make no warranty and assume no liability for scripts, indicators, ideas, and other third-party content. Your use of any script, indicator, idea, or other third-party content is entirely at your own risk.

7. Disclaimer on Investment and Trading Decisions

Decisions to buy, sell, hold, or trade securities, commodities, and other investments involve risk and should preferably be made with the advice of qualified financial professionals. Any trading in securities or other investments involves a risk of substantial losses. The practice of “Day Trading” carries particularly high risks and can cause you to lose significant amounts of money. Before undertaking any trading program, you should consult a qualified financial professional. Carefully consider whether such trading is appropriate for you, given your financial situation and ability to bear financial risks. Under no circumstances will we be liable for any loss or damage you or any other person incurs as a result of any investment or trading activity in which you or any other person engages based on any information or material received through TradeGATEHub or our services.

8. Disclaimer on Hypothetical Performance Results

Hypothetical performance results have many inherent limitations, some of which are described below. No representation is being made that any account will achieve or is likely to achieve profits or losses similar to those shown. In fact, there are frequently significant differences between hypothetical results and the actual results subsequently achieved by any particular trading program.

One of the limitations of hypothetical results is that they are generally prepared with the benefit of hindsight. In addition, hypothetical trading does not involve financial risk, and no hypothetical trading record can completely account for the impact of financial risk in actual trading. For example, the ability to withstand losses or to adhere to a particular trading program despite losses are material factors that can adversely affect actual trading results. There are numerous other market-related factors or the implementation of any specific trading program that cannot be fully accounted for in the preparation of hypothetical performance results, all of which can adversely affect actual trading outcomes.

9. Registered Users

Certain services, such as saving charts, publishing them, or the ability to comment on published charts, are available only to registered users of the TradeGATEHub website and require you to log in with a username and password. If you register as a user (a “Subscriber” or “member”) of any of the features of TradeGATEHub, you may be asked during the registration process to click “Register Now,” “Submit,” or a similar button; by clicking such a button, you further confirm your acceptance of being legally bound by these Terms of Use.

In consideration of your use of the TradeGATEHub website, you represent that you are of legal age to form a binding contract and are not a person barred from receiving the services of TradeGATEHub under the laws of the United States or any other applicable jurisdiction. You also agree to:
(a) provide true, accurate, current, and complete information about yourself as prompted by the TradeGATEHub registration form (“Registration Data”), and
(b) maintain and promptly update the Registration Data to keep it true, accurate, current, and complete.

If you provide any information that is false, inaccurate, outdated, or incomplete, or if TradeGATEHub has reasonable grounds to suspect that such information is false, inaccurate, outdated, or incomplete, TradeGATEHub has the right to suspend or terminate your account and refuse any current or future use of TradeGATEHub services (or any part thereof).

10. Non-Professional Subscriber Status

CAs an official provider of real-time market data from exchanges (e.g., Nasdaq) to end users, we are required to identify the “Non-Professional” status of any subscriber. By ordering a subscription for market data on TradeGATEHub (except for the following subscriptions: CME GLOBEX, CBOT, COMEX, NYMEX), you confirm the following:

1. You use market data solely for personal use, not for your business or on behalf of any other entity.

2.You are not registered or qualified with the Securities Exchange Commission (SEC) or the Commodities Futures Trading Commission (CFTC).

3.You are not registered or qualified with any securities agency, exchange, association, or regulatory body in any country.

4.You do not perform functions similar to those requiring registration or qualification with the SEC, CFTC, any other securities agency, exchange, association, regulatory body, or any commodities or futures market, association, or regulatory body.

5.You are not an investment adviser (as defined in Section 202(a)(11) of the Investment Advisers Act of 1940) or an asset manager, and you do not provide investment advice to any person or entity.

6.You are not subscribing to the service as an owner, principal, partner, officer, employee, or agent of any business, or on behalf of any other person.

7.You use your own capital, not funds provided by any other person or entity, to engage in trading.

8.You do not trade for the benefit of a corporation, partnership, or other entity.

9.You have not entered into any agreement to share the profits of your trading activities or to receive compensation for your trading activities.

10.You do not receive office space, equipment, or other benefits in exchange for your trading or work as a financial consultant to any person, business, or commercial entity.

11. Derived Data

Our proprietary derivation process consumes raw market data and executes a two-factor derivation process to produce the displayed price, which is subsequently used by the pricing engine. Derived market data comes from and is supplied through multiple sources and may therefore be combined.

The derivation process involves modifying the raw price by a factor determined by trading volume in the underlying market, a random variable, and a maximum displacement amount. Derived data pricing is displayed only to our non-professional clients, and such pricing is proprietary to the organization.

At no time is raw data accessible to any client, nor can such data be reconstructed in any way. All markets pass through the same derivation engine.

12. Access and Security

You accept responsibility for the confidentiality and use of any username and email address you use to register and access our services. You are responsible for maintaining the confidentiality of your password and account and assume full responsibility for all activities that occur under your password or account. You agree to:
(a) immediately notify TradeGATEHub of any unauthorized use of your password or account or any other breach of security, and
(b) ensure that you exit from your account at the end of each session.

TradeGATEHub cannot and will not be liable for any loss or damage arising from your failure to comply with these obligations.

TradeGATEHub considers private information on the site (protected or invitation-only script source code, etc.) to be confidential to you. TradeGATEHub protects such private information from unauthorized use, access, or disclosure in the same way that it protects personal data (see our Privacy Policy for more information).

13. Payment and Cancellation of Service – For Paid Services

By ordering any subscription at www.tradegatehub.com (including a free trial period), you confirm that you have read and accepted our Terms of Use and authorize TradeGATEHub to automatically charge your bank card or PayPal account according to the billing period you selected.

• Each user may try any paid plan for 30 days free of charge. If the trial is not canceled before its expiration date, it will automatically convert into a monthly or annual paid plan, depending on the user’s choice.
• There are no refunds for monthly plans, even if the subscription is canceled on the same day the automatic conversion payment was made. Refunds are only available after an automatic charge for annual payments (i.e., after the trial and after renewal) within 14 calendar days of payment. Users who have filed a chargeback claim or dispute are not eligible for a refund.
• PRO, PRO+, and Premium subscriptions automatically include market data available without additional fees per user only. You can view which markets are available free of charge and which must be purchased separately on TradeGATEHub.
• A canceled trial and associated services will stop immediately upon cancellation, except for data packages that may have been purchased.

Billing is prepaid monthly, annually, or biennially. No refunds or credits will be given for partial months of service, nor refunds for unused months with an active account. If automatic renewal fails for an annual plan, you will automatically be switched to a monthly plan.

All billing is recurring, meaning you will continue to be charged until you cancel your subscription. You are solely responsible for properly canceling your TradeGATEHub subscription. An email request or support ticket requesting cancellation is not considered valid cancellation. You may cancel your subscription at any time by visiting the Billing section in the Profile Settings page.

If you cancel the service before the end of the current paid period, your subscription will remain active until the next due date. After the due date, if no payment is received, your subscription will stop.

• We do not offer refunds for initial payments. Please ensure your order is correct before making payment.

• We do not offer refunds for recurring monthly payments. If you have been charged for the automatic monthly renewal, you may cancel to avoid charges in future months.

• We do not offer refunds for upgrades to a more expensive plan or a longer billing cycle. Remaining days are converted into equivalent value in the new subscription.

• We offer refunds for recurring annual and biennial payments upon request. If you have been charged for the automatic annual or biennial renewal, you have 14 calendar days (after payment) to contact our support team. If you do not, the renewal will be deemed accepted and the payment will not be refunded.

• Refunds are only available after an automatic charge for annual payments (i.e., after the trial and after renewal) within 14 calendar days of payment.

Our moderators are official representatives of TradeGATEHub, with the authority to warn or block users (including paid subscribers) who fail to comply with the Rules. We do not offer refunds if you are blocked from posting content and interacting with others, as your paid subscription and all features and/or data will remain available during any ban.

14. Feedback to TradeGATEHub

By submitting ideas, content, suggestions, documents, and/or proposals (“Contributions”) to TradeGATEHub through our contact or feedback pages, you acknowledge and agree that:
(a) your Contributions do not contain confidential or proprietary information;
(b) TradeGATEHub is not under any obligation of confidentiality, express or implied, regarding the Contributions;
(c) TradeGATEHub shall be entitled to use or disclose (or choose not to use or disclose) such Contributions for any purpose, in any way, in any medium, worldwide;
(d) TradeGATEHub may have something similar to the Contributions already under consideration or in development;
(e) your Contributions automatically become the property of TradeGATEHub, without any obligation on the part of TradeGATEHub to you; and
(f) you are not entitled to any compensation or reimbursement of any kind from TradeGATEHub under any circumstances.

15. Indemnification

You agree to indemnify and hold harmless TradeGATEHub and our subsidiaries, affiliates, officers, agents, employees, partners, and licensors from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of content you submit, post, transmit, modify, or make available through the services of TradeGATEHub, your use of the services of TradeGATEHub, your connection to the services of TradeGATEHub, your violation of the Terms of Use, or your violation of any rights of another.

16. Termination

At your request, your account may be deleted from TradeGATEHub. You may delete your account at any time by visiting the Profile Settings page. If you requested deletion of your account, we will delete the personal data associated with your account; however, certain personal data will be retained if it has been integrated into data that is an integral part of our systems and site, including data in communications you have sent through our site. Such data is necessarily retained for site integrity and our legitimate business interests, including audits, security, and other legitimate purposes (see our Privacy Policy for more information). Your Contributions may remain on the site at our discretion. Once a Contribution is published, it becomes part of the collective commercial knowledge base and must remain so. This policy prevents users from keeping only their best ideas public, ensuring honesty and public trust in the site’s reputation and integrity.

You agree that TradeGATEHub may, without prior notice, terminate, limit your access, or immediately suspend your TradeGATEHub account, any associated email address, and access to TradeGATEHub services. Causes for such termination, access limitation, or suspension include, but are not limited to:
(a) breaches or violations of the Terms of Use or other incorporated agreements or guidelines,
(b) requests by law enforcement or government agencies,
(c) discontinuance or substantial modification of TradeGATEHub services (or any part thereof),
(d) unexpected technical or security issues,
(e) extended periods of inactivity,
(f) and/or participation in fraudulent or illegal activities.

You further agree that all terminations, access limitations, and suspensions for cause shall be made at the sole discretion of TradeGATEHub, and that TradeGATEHub shall not be liable to you or any third party for any termination of your account, associated email address, or access to TradeGATEHub services.

17. Emails

By creating an account on TradeGATEHub, you agree that TradeGATEHub may use your email address to send you marketing materials, service-related notices, messages with important information, special offers, etc. You may unsubscribe by clicking the link provided in such emails.

18. Community Rules

By creating and using an account on TradeGATEHub, you confirm that you have read and agree to comply with our Community Rules (House Rules).

19. Third-Party Software

Our software, website, and/or services may include software components supplied by third parties, which are used with the permission of the respective licensors and/or copyright holders, under the terms provided by such parties (“Third-Party Software”). TradeGATEHub expressly disclaims any warranty or other assurance to you with respect to the Third-Party Software. Please note that your use of Third-Party Software will be governed by the terms and conditions of use and privacy policies of the providers of such software, and not by these Terms of Use or our Privacy Policy.

20. Scripts

You represent and warrant that you own all intellectual property rights, including all patents, trademarks, trade secrets, copyrights, or other proprietary rights necessary for your script. If you use third-party materials, you represent and warrant that you have the right to distribute such third-party material in the script. You agree not to submit material that is copyrighted, protected by trade secret, or otherwise subject to third-party proprietary rights, including patent, privacy, or publicity rights, unless you are the owner of such rights or have permission from the rightful owner to submit the material.

You are solely responsible for any script you create. TradeGATEHub is in no way responsible for the use or misuse of your script by any user. Likewise, TradeGATEHub is in no way responsible for the use or misuse by you of any other user’s script.

By using the script publishing feature, you grant us a worldwide, irrevocable, perpetual, royalty-free license to:

• Publish the script as well as the author’s username,
• Disclose the source code of the script for open scripts,
• Run, display, use, and make your open or protected script available to any user, or an invite-only script available to any user who has received an invitation.

We may remove your script without prior notice if we reasonably believe you are violating these Terms of Use.

You may publish the script under any license. If you do not include a license in the comment section of a script, you agree that your script is licensed under the Mozilla Public License 2.0.
